At San Diego National Bank, customer service is very important to us. As we continue to improve and expand our services and delivery channels, we recognize that our customers need and desire to preserve their privacy and confidentiality. We comply with all federal and state privacy laws, including the California Financial Privacy Bill (CA SB1).

Protecting Customer Information

San Diego National Bank maintains physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information. Nonpublic personal information means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records.

We have developed and implemented security procedures to help maintain customer confidentiality and prevent unauthorized access to customer information. We continually assess new technology for protecting information and upgrade our systems when appropriate.

Keeping your information secure is one of our most important responsibilities. We, at San Diego National Bank, have adopted standards that hold our employees responsible for maintaining and preserving customer confidentiality.

Ensuring Accurate Information

We, at San Diego National Bank, also are committed to maintaining accurate and complete records of your financial information and diligently pursuing the resolution of any reported or known inaccuracies or discrepancies. Should you believe that our records contain inaccurate or incomplete information about you, please notify us. We will investigate your concerns to resolve the inaccuracy or discrepancy. Please refer to your account or transaction disclosures for the reporting procedures.

Information We Collect

We collect and use various types of information to service your accounts, save you time and money and better understand your needs. Customer Information we collect is categorized into the following three types:

  • Information you provide to us on applications or other forms. Examples of this type of information include your name, address, Social Security number, credit history and other financial information
  • Information about your transactions and account experience with us or our affiliates, or others. For example, your account balance, payment history, and other transactions
  • Information from consumer reporting agencies, such as information relating to your credit worthiness
Information We Disclose, as Permitted by Law

We do not disclose any nonpublic personal information about our customers or former customers to nonaffiliated third parties except as set forth in this policy and as permitted by law. Some examples of instances when we may disclose nonpublic information about our customers or former customers include:

  • To effect, administer, or enforce a transaction you requested;
  • To service or process a financial product or service you requested;
  • To protect you against fraud;
  • To comply with laws or regulations; and
  • When you provide us with your permission

Sometimes, in order to provide you with better service, we contract with third-party service providers. We require that our third-party providers honor our customers’ rights to privacy. We may disclose all of the information we collect, as described above, to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements. San Diego National Bank does not provide our customers’ information to mailing lists or any other marketing agency other than for our use to market San Diego National Bank products.

Please be advised the opt-out rights will not apply to the sharing of information with these third parties described above.

Availability of Disclosure of Privacy Policy

This disclosure is also available in our banking offices. This disclosure of our privacy policy applies to consumers. We reserve the right to change our Privacy Statement, and if we do so, we will notify you.

Fair Credit Reporting Act Notice of Sharing Information with Affiliates

Under the federal Fair Credit Reporting Act, we are permitted to share your name, address and facts about your transactions and experiences (such as your payment history and other transactions on your accounts with us) among our affiliated companies. An affiliate is a company or banks, with which we are related by common ownership or affiliated by corporate control, so that they may offer or provide additional services to you. That information is referred to in this Privacy Policy as "transaction information." We also may share other information we obtain about you (i.e. from third parties, such as credit reporting agencies) with those companies, unless you notify us before the information is initially communicated that you do not want us to share that information. You can tell us not to share such information by completing the opt-out form attached, fill in all the requested information, and return the form to the address provided. Once we receive your opt-out request, we will stop sharing information as soon as reasonably practical.

How to Opt Out

If you do not want us to share your information with our affiliates, write to us at the address below. Your opt out will apply to all accounts you hold individually and to all accounts you hold jointly with other persons. Your opt out will not apply, however, to any accounts your joint account holders hold individually or jointly with persons other than you.

Frequently Asked Questions

If I send in an opt-out form to the bank, do I have to redo this form each year or will my initial request remain in effect?
You do not need to renew your opt-out instructions with the bank. One will remain in effect indefinitely unless you contact us to cancel it.

Is it true that credit bureaus can share my credit information, mailing address, telephone number and other information to anyone who requests it unless I opt out?
No, credit bureaus can’t release the information in your credit report to just anyone who asks for it. Under the Fair Credit Reporting Act, a credit bureau can only provide information to people and businesses with a legitimate right to obtain it, as specified in the law. For example, a company has a right to get your credit report if you apply for a loan.

If I opt out of information sharing because I don’t want unsolicited offers, does this prevent the bank from reporting my creditworthiness to credit bureaus?
No, even if you opt out, the bank still can, and will, report private information to credit bureaus. The privacy law specifically permits the bank to provide nonpublic personal information to credit bureaus.

How do I remove my name from marketers’ mailing and telephone lists to stop unwanted solicitations?
You can call toll-free 888-5-OPTOUT (888-567-8688) to reduce the number of offers for credit cards, insurance and other financial products that you receive. You can also reduce the number of mailings and phone calls from national advertisers by taking advantage of services offered by the Direct Marketing Association. Collecting Information

When you request an online service such as Online Banking or Online Bill Pay through our Web site, we will request information such as a user identification and password to identify you. This information will enable us to service your accounts, to provide you with products and services you have requested, to help us respond to your questions, save you time and money and better understand your needs. We collect only the information necessary to interact with you. San Diego National Bank does not disclose any nonpublic personal information about our customers or former customers to nonaffiliated third parties except as set forth in this policy and as permitted by law. You can visit our Web site without providing us with any personal information about yourself to learn about our history and available career opportunities or access one of our financial planning tools designed to help you choose the products and services that are right for you. If you do not interact with us as you browse the Web site, any personal information such as your e-mail address is not collected.

Privacy for Online Bill Pay Users

In order to provide the Online Bill Pay service, we will collect information about your accounts and relationships with the companies and institutions you specify to be included in your service, in addition to the types and sources of information described in our general San Diego National Bank Privacy Policy. Information that we obtain solely in connection with the Online Bill Pay service will not be disclosed to any third-party except for the purpose of providing this service or as permitted or required by applicable law.

Disclosure of Nonpublic Personal Information to Non-Affiliated Third Parties

We may share online nonpublic personal information with companies that are not our affiliates in the following circumstances:

  • When it is necessary to service your account to complete a transaction you requested or authorized;
  • To protect against fraud
  • When required or permitted by applicable law

We require that our third-party providers honor our customer’s right to privacy.

Making Changes to Your Online Accounts

If you want to make changes to your Online Banking or Online Bill Pay services such as adding or deleting an account to your existing Online Banking Account, we invite you to visit one of our nearby branches and speak with an account representative. Changes to these services may not be completed online.

Changes to Our Online Privacy Policy

Our online privacy policy is updated periodically. When you access our Web site, notification of changes to our Online Privacy Policy will be communicated through our Online Banking Message Center.

Children’s Online Privacy Protection

San Diego National Bank is committed to protecting children’s online nonpublic personal information in the same manner we guard all consumer personal information at our offices, ATM machines, and by telephone. San Diego National Bank does not knowingly collect, use or disclose personal information from children under age 13 without obtaining verifiable parental consent. Our Web site is directed to a general audience, and may be accessed by the public. Should a child whom we know to be under 13 send personal information to us, we will only use that information to respond to a one-time request from the child, provide notice to the child’s parents, or ensure the safety of the child. The Children’s Online Privacy Protection Act (COPPA) protects children under the age of 13 from the online collection of personal information. New Procedures for Opening an Account or Loan Mandated by the USA PATRIOT Act

To help the government fight the funding of terrorism and money laundering activities, the USA PATRIOT Act, a federal law, requires all financial institutions to obtain, verify and record all information that identifies each person or entity that opens an account or loan, including business accounts and loans.

What this means for you

When you open an account or loan, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying document. If you are opening an account or loan on behalf of a business entity, documents relating to the business may also be requested.
